Ask us About TPS for Haitian Nationals

Bernstein Osberg-Braun and de Moraes is pleased to assist Haitian nationals in applying for Temporary Protected Status (TPS). On January 15, 2010, in response to the devastating earthquake in Haiti, the Obama administration announced Temporary Protected Status, an immigration benefit sought for years by Haitian activists, immigrant advocates, and South Florida lawmakers.

Tatiana Bessonova is a native of the Kazakhstan, and speaks fluent Russian. She joins us after three years of work with Department of Homeland Security. A graduate of St. Thomas University School of Law, Tatiana is a member of the Florida Bar, American Bar, and Dade County Bar Associations. While in law school, she was active in pro bono, volunteering for both the State Attorney's Office and the Public Defender's Office. She was also actively involved in the St. Thomas Human Rights Law Review and the St. Thomas International Moot Court. She will be focused on Litigation. Welcome Tatiana!

H-1B Cap has Hit

USCIS has declared December 21st, 2009 the “final receipt date” for new H-1B petitions. It has been determined that there have been sufficient “cap-subject petitions” to reach the 65,000 cap; furthermore, USCIS has received over 20,000 “advanced degree” petitions, which is the yearly limit as well.

All petitions that were received after December 21st, 2009 will not be considered. It is important to remember the date received does not correspond to the postmark date on the petition.

We have already begun to prepare cap-subject H-1B Petitions that will be allocated for fiscal year 2010. These petitions can be filed beginning on April 1st, and the start date for employment is on October 1st, 2010. Also, there are many businesses that may not be subject to the annual H-1B cap, please contact our office to determine whether your company is cap-exempt.
