EB-1 Visa

Aliens with extraordinary ability are those with "extraordinary ability in the sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim and whose achievements have been recognized in the field through extensive documentation. "An alien must provide evidence that they are one of "that small percentage who have risen to the very top of the field of endeavor," to be granted this classification. The alien can apply for residency concurrently with the EB1 Visa.

The individual must submit sufficient documentation to be able to support their extraordinary ability petition. The EB-1 petition may be filed without an approved labor certification.

EB-1 Multinational Executive or Manager Visa

An alien can apply for residency under the EB-1(c) immigrant visa category who has been employed in the U.S. in an executive or managerial position by a company, or affiliate or subsidiary of a company, and who employed the alien outside the U.S. in a managerial or executive capacity

  • For at least 1 year in the past 3 years if the alien is currently outside of the U.S.; or

  • For at least 1 year in the 3 years preceding the alien's entry into the U.S. if currently working in the U.S.
